Terms and Conditions for HomeTown IT

1. Introduction
Welcome to HomeTown IT ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website and services. By accessing our website or using our IT repair services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. Services
2.1 Service Description
HomeTown IT provides IT repair and support services for individuals and businesses in NSW, Australia. Our services include but are not limited to computer repair, software installation, virus removal, data recovery, network setup, and technical support.
2.2 Service Availability
We strive to provide our services in a timely manner. However, service availability may be affected by factors beyond our control. We reserve the right to refuse service to anyone for any reason at any time.
3. Appointments and Service Requests
3.1 Booking Appointments
Appointments can be booked through our website, by phone, or email. We will make reasonable efforts to accommodate your preferred time and date, but cannot guarantee availability.
3.2 Cancellations
If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Failure to do so may result in a cancellation fee of up to 50% of the quoted service price.
3.3 No-Shows
If you fail to be present for a scheduled appointment without prior notice, a no-show fee may be charged equal to the minimum service call fee.
4. Pricing and Payment
4.1 Pricing
Service prices are provided upon request and are subject to change without notice. All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
4.2 Quotes and Estimates
Any quotes or estimates provided are valid for 14 days and are subject to change if the scope of work changes or if additional issues are discovered during the repair process.
4.3 Payment Methods
We accept payment by credit card, debit card, direct bank transfer, and cash. Full payment is required upon completion of services unless prior arrangements have been made.
4.4 Late Payment
Overdue accounts may be subject to a late payment fee of 2% per month on the outstanding balance. You agree to pay all costs incurred in collecting overdue accounts.
5. Parts and Equipment
5.1 Sourcing of Parts
We may need to order parts or equipment to complete repairs. We will notify you of any additional costs before proceeding with the order.
5.2 Warranties on Parts
All new parts installed carry the manufacturer's warranty. Used or refurbished parts may have limited or no warranty, which will be disclosed at the time of service.
6. Service Warranties
6.1 Workmanship Warranty
We provide a 30-day warranty on our workmanship. If the same issue recurs within this period, we will rectify it at no additional charge.
6.2 Warranty Limitations
Our warranty does not cover:

Problems unrelated to the original repair

Damage caused by accidents, misuse, or abuse

Software issues or virus infections occurring after service completion

Issues resulting from unauthorized repairs or modifications

Normal wear and tear
7. Customer Responsibilities
7.1 Data Backup
You are responsible for backing up your data before service. While we take reasonable precautions, we are not responsible for data loss that may occur during the repair process.
7.2 Software Licenses
You must provide valid licenses for any software you wish us to install or reinstall.
7.3 Authorized Service
You warrant that you are the owner of the equipment to be serviced or have the owner's permission to authorize repairs.
8. Liability Limitations
8.1 Service Limitations
We will make reasonable efforts to diagnose and repair issues but cannot guarantee that all problems can be resolved.
8.2 Consequential Damages
To the maximum extent permitted by law, we are not liable for any indirect, special, incidental, or consequential damages, including but not limited to loss of data, loss of use, or loss of profits.
8.3 Limitation Amount
Our maximum liability for any claim arising from our services shall not exceed the amount paid for the services giving rise to the claim.
9. Consumer Guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
10. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose personal information.
11. Intellectual Property
All content on our website, including text, graphics, logos, and software, is our property or the property of our licensors and is protected by Australian and international copyright laws.
12. Uncollected Equipment
12.1 Collection Period
Repaired equipment must be collected within 30 days of being notified that repairs are complete.
12.2 Storage Fees
Equipment not collected within 30 days may incur storage fees of $10 per day.
12.3 Abandoned Equipment
Equipment not collected within 90 days may be considered abandoned and may be disposed of or sold to recover unpaid fees. Any surplus funds from such sales will be returned to you after deducting all outstanding amounts.
13. Dispute Resolution
13.1 Good Faith Resolution
If a dispute arises, both parties agree to attempt to resolve it in good faith through direct negotiation.
13.2 Mediation
If direct negotiation fails, either party may request mediation through a mutually agreed mediator before pursuing legal remedies.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the modified Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
